The Federal Government has gazetted 1 February 2026 as a dual public holiday for Thaipusam and Federal Territory Day.
Federal Territory Day is a mandatory public holiday for private sector employers in Kuala Lumpur, Putrajaya, and Labuan under Section 60D(1)(a)(iii) of the Employment Act 1955, which is currently in force.
As 1 February 2026 falls on a Sunday, employers whose weekly rest day is Sunday are required to grant a replacement holiday on the following working day, which is Monday.
This replacement holiday is compulsory and cannot be substituted with another day at the employer’s discretion.
Employers who have chosen Thaipusam as one of their six optional public holidays under the Employment Act 1955 must also provide a replacement holiday.
As both public holidays fall on the same date, the replacement holiday for Thaipusam must be given on the next working day, which is Tuesday.
Alternatively, employers may grant another day as a paid replacement holiday, provided this is done with the employee’s consent, in line with Section 60D(1A) of the Act.
Employees who are required to work on either Thaipusam or Federal Territory Day are entitled to public holiday pay at the rate set out under Section 60D(3) of the Employment Act 1955.
The dual public holiday on 1 February 2026 has been officially gazetted and is legally binding.
Employers should ensure that replacement leave and payroll arrangements comply with the Employment Act 1955, while employees are encouraged to confirm their leave entitlements with their employers ahead of time.
