Taxpayers are urged to verify their tax arrears and any existing travel restrictions before making plans to travel abroad for the Aidilfitri holiday.

In a statement, the Inland Revenue Board (IRB) reminded the public that it holds the authority to prevent individuals from leaving Malaysia if they, or companies under their name, have unsettled tax arrears with the government. This enforcement power is granted under Sections 104 and 75A of the Income Tax Act 1967, as well as Section 22 of the Real Property Gains Tax Act 1976.

The IRB emphasised that travel restrictions are only imposed as a last resort, following multiple reminders and notices regarding outstanding taxes.

Those intending to travel overseas are advised to check their tax status through the MyTax portal, available at its website. Additionally, individuals may confirm whether they are subject to travel restrictions via the Malaysian Immigration Department’s portal here.

If a taxpayer is found to have tax arrears and is subject to travel restrictions, they are required to settle the full amount or contact the relevant HASiL Office to negotiate instalment payments, in order to restore their ability to travel.

Applications for the removal of travel restrictions can be submitted online through the e-Travel Restriction service on the MyTax portal. Applicants must meet specific conditions, including being a Malaysian citizen and having made full payment. Travel restrictions must also have been imposed under the Income Tax Act 1967 and must not relate to restrictions on company directors.

Alternatively, taxpayers may apply to lift travel restrictions by following existing procedures, which include contacting the HASiL Contact Centre at 03-8911 1000 or visiting the nearest IRB office during operating hours.

For further details on the e-Travel Restriction service, frequently asked questions are accessible via the IRB’s website here
